A Tampa judge overturned a ruling made on a man arrested for drug charges in 2009 after reevaluating the details of the incident which involved a Hillsborough Deputy. The defendant was represented by Tampa attorney, Joseph J. Registrato. A circuit judge in Tampa overturned the arrest of a man for marijuana and other drug charges in August 2009. The reason for the overturn was that the judge learned a Hillsborough Sheriff Deputy searched the man without first getting his consent. The Hillsborough Sheriff Deputy testified in court that the man under arrest had consented to having his pants' pockets searched- where an illegal drug was found. However, the defendant testified that he never gave consent. Because the rules of search and seizure, in this particular case, require consent, the Deputy's search was found unlawful.
The judge wrote in his order: "This issue is one of consent. The court finds the Defendant did not give the deputy consent to search his person . . . . The defendant's motion is granted." "Rulings such as this one are not popular among law enforcement," said Registrato. "Judges who make such rulings show great courage."
Registrato went on to say, "The right to be free from unreasonable searches is really the only thing that separates the United States from many other countries. I have always liked the phrase, 'Love your country, fear your government,' because it expresses something real and what many people do not understand. There is a big difference between 'country,' and 'government,' and people do not always make the distinction."

A 65-year-old Tampa man, who was represented by criminal defense attorney Joseph Registrato, was released from his state prison sentence due to improperly introduced evidence during trial. A 65-year-old Tampa man was released from state prison after he was convicted and sentenced to 25 years in prison in December 2010. The man was convicted by a jury in Tampa for allowing a young child to touch him in a sexual way. He claimed innocence throughout the duration of the trial and held a clean record. However, the jury convicted him of a sex crime which carries a minimum mandatory prison sentence.
The man was represented by Joseph J. Registrato, criminal defense attorney of the Tampa Bay area. After careful evaluation, the man's conviction was reversed by an appeal court.
The Second District Court of Appeal said in its published opinion that five issues were raised by the appeal, but only one of the appeals needed to be taken into consideration. That point had to do with evidence that was improperly introduced at trial by the prosecution-- evidence that could have possibly have swayed the jury's decision. The appeal court said the improper admission of that evidence warranted a mistrial. However, a motion made by the defense was denied.
