Domestic violence is dangerous and harmful to everyone concerned. But false allegations of domestic violence, whether to gain an advantage in a divorce proceeding or as a cheap and easy way to get somebody out of the house.
Process Subject To Abuse
The procedure for obtaining a domestic violence injunction is made easy so that anybody may get protection quickly and without expense. Because it's so easy to get, without verification or other evidence, people often exaggerate or lie in order to get one. Unfortunately, there is little protection against this abuse, at least in the short run.
However, people who are the victim of such lies may vindicate their rights at a hearing which will be scheduled a week to ten days after the temporary injunction is issued. You are entitled to be represented by a lawyer at that hearing and you should take advantage of that right. We have represented dozens of people in these hearings.
Criminal Domestic Violence
In addition to domestic violence injunctions, you may be charged with the crime of assault and/or battery and be thrown in jail without bond in a domestic violence case. This is a criminal charge and may carry a jail sentence. All persons so charged should have a lawyer to represent them.
In domestic violence cases, the state often offers defendants a chance to enter what is called pre-trial intervention program, which may be an easy way out, but also carries with it certain risks. You should consult an attorney before making the election to enter such a program.
