Divorce

Negotiate Sure, but Ready to Fight

Joseph J. Registrato, Attorney At Law in Tampa-St. Petersburg, Florida
Divorce is always emotional and traumatic. Sometimes, differences people have can be settled through negotiations. But when one party has a right to alimony, the other party seldom will agree to pay it, and therefore a court fight is necessary to get it. The same is true with every right one party has that will cost the other party something -- child support, time with the children, or a part of the marital estate.

Therefore, we always try to settle divorce cases, but we never shy away from fighting for what are clients will be awarded in a court fight.

What are my chances if we go to court?
You still need to know your rights and have a fairly good idea of how a judge might rule if he were to hear the case. Only through experience can a lawyer learn how judges and appeals courts have ruled on the dozens of questions that come up in every divorce. We will be posting some of our appeal briefs (arguments in writing that were submitted to an appeal court), soon so visitors to the site can see how some cases were argued on appeal.

What happened?
When you call about your divorce, we'll be asking questions about your marriage, your financial circumstances, who has been taking care of the kids, what led to your separation? It's all important to know when approaching a divorce battle. Some of the things we'll talk about include:

  1. Your financial circumstances.
  2. The marital estate and whether there was waste of marital property.
  3. The lifestyle you enjoyed during the marriage.
  4. Drugs and other addictions.
  5. Your health and physical condition.
  6. Marital misconduct and the guilt factor.

What besides Divorce?

  • We will fight for your right to make decisions regarding your children.
  • We will fight for your right to have time sharing with your children.
  • We will fight to your right to an equitable division of your marital property.
  • We will have the court enforce its orders against those not in compliance.
  • We will ask the court to modify its orders when necessary and appropriate.
  • We will fight for parents wrongly accused of child abuse, both in criminal court and dependency court.
  • We will fight for parents who want the right to make decisions regarding their children even when there was no marriage.
