It's a crime!
As a state prosecutor, I prosecuted dozens, perhaps hundreds of people for the crime of DUI, and put on my cases in front of juries and judges. I've done the same as a private defense lawyer.
The questions your lawyer wants to know before advising you what to do about a DUI, for which you can go to jail, include the following:
Again, you have rights you probably don't know about
- Was the traffic stop legal? That means, did the police officer have a reasonable suspicion to stop you, or was it based upon insufficient grounds, such as a hunch that you had been drinking?

Did the police officer establish probable cause to arrest you? That means did your driving, behavior, and performance on field sobriety tests give the police officer enough evidence to make an arrest?

How did you look on the video? A video is often the most persuasive evidence in a DUI case, even more persuasive than a breathalyzer or blood test.

Did you refuse to blow into the breathalyzer machine? And if you did blow into the machine, what was the result?

Did you make any statements to the police officer about whether you were drinking at some point before you drove?

Was there an accident in your case, and if so, was anybody injured. The law, and most citizens, treat accident cases as much more seriously.
